By visiting the site, you agree that the laws of the State of California, without regard to principles of conflict of laws, will govern this Terms and Conditions of Use agreement and any dispute of any sort that might arise between you and The Art of Shadow relating to that agreement.
ARBITRATION
If any dispute arises between you and The Art of Shadow with regards to any purchase, return, transaction, email submission, or any other act dealing with the content, products or services offered by The Art of Shadow to you, no matter how characterized or classified, or if there is a dispute with regard to performance under the terms of this Agreement, no matter the nature of the claims or issues, any and all such disputes shall be resolved by binding arbitration to be heard by a retired Judge of the Los Angeles Superior Court, mutually selected by you and The Art of Shadow (the "Parties"). If the Parties cannot agree upon a retired Judge, then each Party shall select one Judge and then the two Judges shall select a third Judge who shall act as sole arbitrator. The decision of the two Judges in selecting the third Judge shall be final and incontestable by any Party. The prevailing party shall be entitled to recover all reasonable costs and attorneys' fees.
SITE POLICIES, MODIFICATION AND SEVERABILITY
We reserve the right to make changes to our site, policies, and this Terms and Conditions of Use agreement at any time and in our sole discretion; therefore, you should review those policies, terms, and conditions each time you visit the site. Your continued use of the site after we make any such changes constitutes your binding acceptance of those changes. If any of the terms or conditions herein shall be deemed invalid, void, or for any reason unenforceable, that term or condition shall be deemed severable and shall not affect the validity and enforceability of any remaining term or condition.
COMPLETE AGREEMENT
This Agreement constitutes the entire understanding between The Art of Shadow and its users. It cannot be amended without an express writing signed by an owner of The Art of Shadow. The Art of Shadow specifically disclaims the validity of an oral representation in conflict with the terms of this Agreement made by any of its employees.
RETURN POLICY
Beverly Bay will accept product returns for workmanship defects that are found within the product's warranty period. An exclusion will apply to Custom-fit vehicle covers. In this case, returns for workmanship defect are allowed for 30 days from the ship date. We will not accept custom-fit returns for wrong color given, wrong year given, wrong make given or wrong model given. If a defect is found, per the terms mentioned above, we reserve the right to fix or replace the product. Please note that the color settings on your computer monitor may affect the way in which colors are displayed. If you are uncertain about the product's actual color, we can arrange to ship you a fabric swatch.All returns must be discussed with The Art of Shadow before you send back the product.
